Where This Leaves Developers
For companies building AI systems, the fragmentation creates headaches. A model that meets EU AI Act requirements, UK Safety Institute guidelines, and potential US executive order rules still faces no standardized requirements for sale in China, India, or the Middle East. The compliance burden falls heaviest on Western firms while competitors operate with lighter oversight.
Some developers are adapting by regionalizing their offerings. Meta's Llama models, released as open weights, have been downloaded and modified extensively in jurisdictions with minimal safety requirements. The company can't control downstream use. It can only choose whether to release at all.
Microsoft and Google have taken different approaches, declining to offer certain frontier capabilities in markets where they can't verify compliance with their own safety policies. This self-restriction creates market openings for less cautious competitors.
The November summit in France, hosted by President Emmanuel Macron, will test whether any binding architecture can emerge. French officials have signaled interest in treaty-like instruments, possibly through the OECD or a new dedicated body. But China's likely absence and the US election timing — the summit falls one week after Americans vote — suggest modest expectations.
What would change the calculus? A catastrophic AI incident might concentrate minds. So might competitive pressure if leading labs coordinate to make safety a market differentiator rather than a cost center. For now, the default trajectory is clear: multiple competing standards, uneven enforcement, and continued access to ai tools free of uniform international constraint.
The Seoul Declaration isn't meaningless. It preserves diplomatic channels, funds useful research, and creates norms that might harden over time. But it also illustrates how quickly the window for coherent global governance may be closing. The countries that declined to sign aren't waiting for permission to build.
